Bu Kullanım Şartları, Aydınlatma Metni, Açık Rıza Metni ve Gizlilik Politikası ile birlikte okunmalıdır.

Bu Kullanım Şartları ("Şartlar"), Hatice Eser tarafından sunulan SightUp mobil uygulamasının ("Uygulama") kullanımına ilişkin koşulları düzenler.

1. Taraflar

• Hizmet Sağlayıcı: Hatice Eser ("SightUp", "biz")
• Kullanıcı: Uygulamayı cihazına kuran ve kullanan gerçek kişi

2. Hizmetin Tanımı

SightUp; kullanıcıların gözlük reçetelerini, kontakt lenslerini ve göz damlalarını dijital olarak kaydetmelerine, geçmiş numaralarını görüntülemelerine ve değişimlerini kronolojik olarak takip etmelerine olanak sağlayan, size ait kişisel bir göz sağlığı defteri / organizasyon uygulamasıdır.

Uygulama iki kullanım modunda hizmet verir:

• Ücretsiz Kullanım: Hesap açmadan (misafir) kullanırsanız kayıtlarınız cihazda saklanır; yalnızca kod ile geçici paylaşım kullandığınızda seçtiğiniz özet, kodun 5 dakikalık ömrü boyunca sunucuda tutulur. Giriş yaptığınızda, açık rızanızla, muayene/reçete kayıtlarınız ile lens, göz damlası ve sarı nokta (Amsler) testi kayıtlarınız hesabınıza yedeklenir (Supabase, AB — Almanya/Frankfurt); bu bulut yedekleme premium şartına bağlı değildir. Fotoğraftan okuma (OCR) ve kod ile geçici paylaşım, giriş yapmış ücretsiz hesaplarda ödüllü reklam izlenerek kullanılabilir (OCR ayrıca günlük sınıra tabidir). Ücretsiz katmanda kişiselleştirilmemiş reklam gösterilebilir; premium tüm reklamları kaldırır.
• Premium Kullanım: Ücretli abonelik; reklamsız kullanım (yapay zekâ ile okuma dahil), paylaşımda tüm muayeneler, geçmiş tedaviler ve değişim grafikleri ve fotoğraftan okumada çok daha geniş günlük kullanım hakkı sunar. "Fotoğraftan oku" özelliğinde fotoğraf, bilgi çıkarımı için ayrı açık rıza ile yurt dışındaki bir yapay zekâ servisine (Google Gemini) işlem anında iletilir; ayrıntılar Aydınlatma Metni ve Gizlilik Politikası'ndadır.

3. Tıbbi Sorumluluk Reddi

ÖNEMLİ: SightUp bir tıbbi cihaz, tanı aracı veya tedavi yönlendirme sistemi değildir.

• Uygulama tıbbi tanı koymaz, tedavi önerisi sunmaz, reçete düzenlemez.
• Uygulamada görüntülenen grafikler ve kayıtlar yalnızca kullanıcının kendi girdiği verilerin görselleştirilmesidir.
• "Fotoğraftan oku" (OCR) özelliği, fotoğraftaki numaraları yapay zekâ ile çıkarır; sonuç %100 doğru olmayabilir. Kaydetmeden önce değerleri mutlaka kontrol etmeniz gerekir. Yanlış veya eksik okumadan doğabilecek sonuçlardan SightUp sorumlu tutulamaz.
• Göz sağlığınızla ilgili her türlü karar için mutlaka bir göz hekimine başvurmanız gerekmektedir.
• Uygulamadaki bilgilere dayanarak alınacak kararlardan, yapılacak veya yapılmayan işlemlerden SightUp sorumlu tutulamaz.

4. Hesap ve Veri Sorumluluğu

• Bulut yedekleme, fotoğraftan okuma ve premium özellikler için bir hesap (e-posta/şifre, Google veya Apple ile) oluşturmanız gerekir. Kod ile geçici paylaşım hesapsız (misafir) kullanımda da mümkündür.
• Hesap güvenliğinizden (şifre gizliliği dâhil) siz sorumlusunuz.
• Hesap açmadan (misafir) kullanırsanız verileriniz yalnızca cihazınızda kalır; cihaz kaybı veya uygulamanın silinmesi durumunda bu veriler kaybolabilir. Giriş yapıp bulut yedeklemeye açık rıza vermeniz bu riske karşı koruma sağlar.
• Verilerinizin doğruluğundan ve uygulamaya girdiğiniz bilgilerden siz sorumlusunuz.

5. Kullanıcı Yükümlülükleri

Uygulamayı kullanırken:

• Yalnızca kendi reçetelerinizi veya yasal temsilcisi olduğunuz kişilerin reçetelerini girmeyi,
• Uygulamayı yasalara ve bu Şartlara aykırı amaçlarla kullanmamayı,
• Uygulamanın güvenliğini tehdit eden eylemlerde (tersine mühendislik, izinsiz erişim, otomatik bot kullanımı) bulunmamayı,
• Başkalarının fikri mülkiyet veya kişisel veri haklarını ihlal etmemeyi

kabul edersiniz.

6. Premium Abonelik

• Premium abonelik Apple App Store veya Google Play üzerinden yönetilir.
• Abonelik iptal edilmediği sürece otomatik olarak yenilenir.
• İptal işlemleri ilgili uygulama mağazasının hesap yönetiminden yapılır.
• İade talepleri ilgili uygulama mağazasının politikalarına tabidir.
• Ödeme bilgileriniz tarafımızca saklanmaz; ödeme süreçleri tamamen ilgili mağaza altyapısı üzerinden yürütülür. Abonelik durumu, RevenueCat abonelik yönetim servisi aracılığıyla hesabınıza bağlanır.
• Premium özellikler zamanla değişebilir; temel işlevsellik korunur.

7. Fikri Mülkiyet

• Uygulamanın kendisi, tasarımı, yazılım kodu, logosu ve markası üzerindeki tüm haklar saklıdır.
• Kullanıcı tarafından girilen reçete verileri kullanıcıya aittir.
• Uygulamanın herhangi bir bileşeninin izinsiz kopyalanması, çoğaltılması veya türev çalışma yaratılması yasaktır.

8. Hizmetin Sürekliliği

• Uygulamanın kesintisiz çalışacağı garanti edilmez.
• Bakım, güncelleme veya teknik nedenlerle hizmet geçici olarak durdurulabilir.
• Bulut bileşenlerinde (Supabase altyapısı vb.) kesinti yaşanabilir.
• Uygulama özellikleri makul bir süre önce bildirim yapılarak değiştirilebilir.

9. Sorumluluğun Sınırlandırılması

Yürürlükteki mevzuatın izin verdiği azami ölçüde:

• SightUp, Uygulamanın kullanımından doğabilecek dolaylı, arızi veya sonuç olarak ortaya çıkan zararlardan sorumlu değildir.
• Kullanıcının uygulamadaki bilgilere dayanarak aldığı kararların sonuçlarından SightUp sorumlu tutulamaz.
• Üçüncü taraf servislerinden (Apple, Google, Supabase vb.) kaynaklanan kesinti, hata veya veri kayıplarından SightUp sorumlu değildir.
• Cihazınızda oluşabilecek veri kayıplarından SightUp sorumlu değildir.
• Uygulama "olduğu gibi" (as-is) sunulur; zımni veya açık hiçbir garanti verilmemektedir.

Tüketicinin Korunması Hakkında Kanun kapsamındaki tüketici hakları saklıdır.

10. Üçüncü Taraf Hizmetlerle Entegrasyon

Uygulama; kimlik doğrulama ve bulut yedekleme için Supabase, "Apple ile Giriş"/App Store için Apple, "Google ile Giriş"/Google Play için Google, abonelik yönetimi için RevenueCat, fotoğraftan okuma (OCR) için Google Gemini ve ücretsiz katmanda reklam için Google AdMob servisleriyle entegre çalışır. Bu servislerin kullanımı:

• İlgili servisin kendi kullanım şartlarına tabidir,
• Bu servislerin politika veya fiyat değişikliklerinden SightUp sorumlu değildir,
• Gerekli durumlarda alternatif servis sağlayıcılara geçiş yapılabilir.

11. Hesap ve Verilerin Sonlandırılması

• Uygulamayı cihazınızdan silerek kullanımı sonlandırabilirsiniz.
• Premium aboneliği App Store/Google Play üzerinden iptal edebilirsiniz; abonelik sona erdiğinde premium özellikler kapanır.
• Hesabınızın ve bulut verilerinizin kalıcı olarak silinmesini istiyorsanız sightup.support@gmail.com adresine talep gönderebilirsiniz; talebiniz en geç 30 gün içinde sonuçlandırılır.

12. Mücbir Sebep

Doğal afetler, savaş, pandemi, siber saldırı, resmî makam kararları, temel altyapı sağlayıcılarının (Apple, Google, Supabase) kesintileri veya tarafların makul kontrolü dışındaki nedenlerle hizmetin verilememesinden SightUp sorumlu tutulamaz.

13. Bu Şartlarda Yapılabilecek Güncellemeler

Bu Şartlar zaman zaman güncellenebilir. Önemli değişikliklerde:

• Uygulama içinde bildirim yayınlanır,
• Yeni versiyona onay vermeden premium özellikleri kullanamayabilirsiniz,
• Ücretsiz kullanıma devam eden kullanıcılar için geçiş süresi tanınır.

14. Uygulanacak Hukuk ve Yetki

• Bu Şartlardan doğacak uyuşmazlıklarda Türk hukuku uygulanır.
• Uyuşmazlıkların çözümünde Ankara Mahkemeleri ve İcra Daireleri yetkilidir.
• Tüketici niteliğindeki kullanıcılar için Tüketici Mahkemeleri ve Tüketici Hakem Heyetleri'ne başvuru hakkı saklıdır.

These Terms of Use should be read together with the Privacy Notice, the Explicit Consent Text, and the Privacy Policy.

These Terms of Use ("Terms") govern your use of the SightUp mobile application ("App") provided by Hatice Eser.

1. Parties

• Service Provider: Hatice Eser ("SightUp", "we")
• User: The natural person who installs and uses the App

2. Description of the Service

SightUp is your personal eye-health notebook / organization application that lets users digitally record their eyeglass prescriptions, contact lenses, and eye drops, view past values, and track changes chronologically.

The App is offered in two modes:

• Free use: If you use the app without an account (guest), your records are stored on the device; only when you use temporary sharing via code is the summary you select kept on the server for the code's 5-minute lifetime. When you sign in, with your explicit consent, your exam/prescription records as well as your lens, eye-drop and Amsler (macular) test records are backed up to your account (Supabase, EU — Germany/Frankfurt); this cloud backup does not require premium. Reading from a photo (OCR) and temporary sharing via code are available on signed-in free accounts by watching a rewarded ad (OCR is also subject to a daily limit). In the free tier, non-personalized ads may be shown; premium removes all ads.
• Premium use: A paid subscription provides an ad-free experience (including AI scanning), all visits, past treatments and number-change charts in every shared report, and a much higher daily limit for photo scanning. In the "Read from photo" feature, your photo is sent — with separate explicit consent, at the moment of processing — to an AI service abroad (Google Gemini) to extract the information; see the Privacy Policy for details.

3. Medical Disclaimer

IMPORTANT: SightUp is not a medical device, diagnostic tool, or treatment-guidance system.

• The App does not provide medical diagnosis, treatment recommendations, or prescriptions.
• Charts and records shown in the App are only visualizations of data you have entered yourself.
• The "Read from photo" (OCR) feature extracts numbers from your photo using AI; the result may not be 100% accurate. You must review the values before saving. SightUp is not responsible for consequences arising from incorrect or incomplete reading.
• For any decision about your eye health, you must consult an eye doctor.
• SightUp cannot be held responsible for decisions made or actions taken/avoided based on information in the App.

4. Account and Data Responsibility

• An account (email/password, Google, or Apple) is required for cloud backup, photo reading and premium features. Temporary sharing via code also works without an account (guest use).
• You are responsible for your account security (including password confidentiality).
• If you use the app without an account (guest), your data stays on your device only; it may be lost if the device is lost or the app is deleted. Signing in and consenting to cloud backup protects against this risk.
• You are responsible for the accuracy of the data you enter into the App.

5. User Obligations

When using the App, you agree to:

• Enter only your own prescriptions or those of persons for whom you are the legal representative,
• Not use the App for purposes contrary to law or these Terms,
• Not engage in actions that threaten the App's security (reverse engineering, unauthorized access, automated bots),
• Not infringe the intellectual property or personal-data rights of others.

6. Premium Subscription

• Premium subscriptions are managed through the Apple App Store or Google Play.
• Unless cancelled, the subscription renews automatically.
• Cancellation is handled through the relevant app store's account management.
• Refund requests are subject to the relevant app store's policies.
• Your payment information is not stored by us; payment is handled entirely by the relevant store. Subscription status is linked to your account via the RevenueCat subscription-management service.
• Premium features may change over time; core functionality is preserved.

7. Intellectual Property

• All rights in the App itself, its design, source code, logo, and brand are reserved.
• Prescription data entered by the user belongs to the user.
• Unauthorized copying, reproduction, or creation of derivative works of any component of the App is prohibited.

8. Service Continuity

• Uninterrupted operation of the App is not guaranteed.
• The service may be temporarily suspended for maintenance, updates, or technical reasons.
• Cloud components (e.g. Supabase infrastructure) may experience outages.
• App features may be changed with reasonable prior notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• SightUp is not liable for indirect, incidental, or consequential damages arising from use of the App.
• SightUp cannot be held responsible for the consequences of decisions the user makes based on information in the App.
• SightUp is not responsible for outages, errors, or data loss originating from third-party services (Apple, Google, Supabase, etc.).
• SightUp is not responsible for data loss that may occur on your device.
• The App is provided "as is"; no implied or express warranty is given.

Consumer rights under applicable consumer-protection law are reserved.

10. Integration with Third-Party Services

The App integrates with Supabase (authentication and cloud backup), Apple ("Sign in with Apple"/App Store), Google ("Sign in with Google"/Google Play), RevenueCat (subscription management), Google Gemini (photo reading/OCR), and Google AdMob (ads in the free tier). Use of these services:

• Is subject to the respective service's own terms,
• SightUp is not responsible for these services' policy or price changes,
• Alternative providers may be adopted where necessary.

11. Termination of Account and Data

• You may end your use by deleting the App from your device.
• You may cancel the premium subscription via the App Store/Google Play; when it ends, premium features are disabled.
• If you want your account and cloud data permanently deleted, you can send a request to sightup.support@gmail.com; it will be completed within 30 days at the latest.

12. Force Majeure

SightUp cannot be held responsible for failure to provide the service due to natural disasters, war, pandemic, cyberattack, decisions of official authorities, outages of core infrastructure providers (Apple, Google, Supabase), or other reasons beyond the parties' reasonable control.

13. Changes to These Terms

These Terms may be updated from time to time. For material changes:

• An in-app notice is published,
• You may not be able to use premium features without accepting the new version,
• A transition period is granted for users who continue with free use.

14. Governing Law and Jurisdiction

• These Terms are governed by Turkish law.
• The Courts and Enforcement Offices of Ankara have jurisdiction over disputes.
• For users who qualify as consumers, the right to apply to Consumer Courts and Consumer Arbitration Committees is reserved.
